GUWAHATI: The Meghalaya high court has observed that holding the hands of a child and calling them beautiful cannot be considered an act of sexual assault under the Pocso Act, reports Prabin Kalita.
Quashing charges against a 55-year-old man in a recent case, the HC noted in his May 26 order that the petitioner has been accused of holding or touching the hands of the alleged victim.
“The fact that a 55-year-old man appreciating the hands of a young girl saying that your hands are beautiful cannot by any stretch of the imagination be considered an offence under any law,” the court order read.
According to the prosecution, the man, after asking for a glass of water from the alleged nine-year-old victim, grabbed her hand. In her statement, the minor said the man held her hand, stroked it and called it beautiful.
